Terms of Service

Frasogn is a per-second audio streaming service that lets listeners purchase listening time as a prepaid wallet balance and pay creators based on actual seconds listened. Features, pricing tiers and creator-share percentages may change over time and are described in the app.

You must provide accurate information when signing up, keep your credentials confidential, and are responsible for activity under your account. You must be at least 13 years old (or the minimum age in your country) to use Frasogn. Creators may be required to verify identity and provide payout details before receiving payouts.

Purchased seconds are added to your wallet and consumed as you listen. The current base listener rate and creator share are shown in the app and on the "How it works" page. New accounts may receive a free trial balance, which is non-refundable and has no cash value. Purchased balances are non-transferable and may expire if your account is inactive for an extended period, as described in the app.

Payments are processed by our third-party payment processor. All prices are shown in the checkout in the applicable currency and include any taxes required by law. Consumers in the European Economic Area have statutory withdrawal rights under Directive 2011/83/EU; by starting to consume purchased listening time, you expressly consent to immediate performance and acknowledge that your right of withdrawal is lost for the portion already consumed. Unused balances may be refunded at our discretion for verified billing errors.

Creators earn their configured share (currently 55%) of the per-second listener price for verified listening. Payouts are made to the account you configure, subject to identity verification, minimum payout thresholds, and applicable withholding or tax obligations. Detailed rules are shown in your creator dashboard and in the Creator Content & Copyright Terms.

You agree not to (a) upload content you do not have the rights to; (b) circumvent the per-second metering, wallet or payout logic; (c) attempt to disrupt or reverse-engineer the service; (d) use the service to distribute unlawful, harmful, or infringing content; or (e) resell or sublicense access to the service without our written agreement. We may suspend or terminate accounts that violate these rules.

If you upload audio, cover art or metadata, the separate Creator Content & Copyright Terms also apply. You retain ownership of your content and grant Frásögn the licences described in those terms so we can host, stream and monetise it on your behalf.

The service depends on third-party providers (cloud hosting, payments, email, analytics). Their availability and terms may affect the service. We are not responsible for third-party outages or actions outside our control.

To the maximum extent permitted by law, the service is provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Statutory consumer rights that cannot be waived under mandatory law remain unaffected.

To the maximum extent permitted by law, Frásögn ehf.'s aggregate liability arising out of or related to the service in any 12-month period is limited to the greater of (a) the amounts you paid to Frasogn in that period or (b) EUR 100. Frásögn is not liable for indirect, incidental, consequential, special or punitive damages, loss of profits, loss of data, or loss of goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law (including for death, personal injury caused by negligence, fraud, or gross negligence).

You may close your account at any time. We may suspend or terminate access if you materially breach these Terms, if required by law, or if continuing to provide the service would create legal or security risk. Sections that by their nature should survive termination (including payment, disclaimer, limitation of liability, governing law and dispute resolution) will survive.

We may update the service and these Terms from time to time. Material changes will be announced in the app or by email. The "Effective date" above always reflects the current version. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of Iceland, excluding its conflict-of-law rules. The exclusive venue for any dispute is the District Court of Reykjavík (Héraðsdómur Reykjavíkur), except that Frásögn may seek injunctive or equitable relief in any court of competent jurisdiction. Consumer-protection rights that cannot be waived under the law of your country of residence remain unaffected.
