Creator Content & Copyright Terms
Effective date: 20 July 2026 · Governs every upload to Frasogn ehf. ("Frasogn", "we", "us"). By ticking the acceptance box in the upload dialog, you ("Creator", "you") enter into a legally binding agreement with Frasogn on the terms below, in addition to the general Frasogn Terms of Service and Privacy Policy.
1.Ownership & originality warranty
You represent and warrant that, for every audio file, cover artwork, title, description, artist name, tag and other material you upload (collectively, "Content"): (a) you are the sole author and original creator of the Content, or (b) you own, or have obtained in writing, all copyright, neighbouring rights, moral rights, performance rights, mechanical rights, synchronisation rights, publicity rights and any other intellectual-property or personality rights necessary to upload, reproduce, distribute, publicly perform, stream, transmit and monetise the Content worldwide on Frasogn. Uploading Content you did not create and for which you do not hold all necessary rights is strictly prohibited.
2.Third-party rights
You further warrant that the Content does not infringe or violate any copyright, trademark, patent, trade secret, right of publicity, right of privacy, moral right, contractual right or any other right of any third party, and that no third-party consent, license, clearance, release or payment is outstanding. This includes, without limitation, samples, loops, beats, stems, session recordings, quotations, cover versions, translations, adaptations, AI-generated material trained on protected works, and any recognisable voice, likeness or name.
3.License you grant to Frasogn
Solely to operate, promote and provide the Frasogn service, you grant Frasogn a worldwide, non-exclusive, royalty-free (subject to the payout terms of the service), sublicensable and transferable license to host, store, cache, reproduce, transcode, adapt for technical delivery, publicly perform, publicly display, stream, transmit and distribute the Content, and to use your name, artist name, cover artwork and metadata for the purpose of identifying, marketing and promoting the Content and the Frasogn service. You retain ownership of your Content.
4.Prohibited content
You may not upload Content that: (a) is not entirely your own work or fully cleared by you; (b) contains unlicensed samples, karaoke tracks, leaks, bootlegs, live recordings of third-party performers, or DJ mixes containing third-party recordings; (c) misrepresents authorship, impersonates another artist, or uses another person's name, voice or likeness without permission; (d) is unlawful, defamatory, hateful, harassing, or infringes any law of Iceland, the European Union, or any other jurisdiction where the Content is made available.
5.Indemnity
You will defend, indemnify and hold harmless Frasogn ehf., its affiliates, officers, directors, employees, contractors, agents, licensors and service providers from and against any and all claims, demands, actions, investigations, liabilities, damages, losses, settlements, judgments, penalties, fines, costs and expenses (including reasonable attorneys' fees and legal costs) arising out of or in any way connected with: (i) any Content you upload; (ii) any breach or alleged breach by you of these Terms or the warranties in clauses 1, 2 and 4; (iii) any infringement or misappropriation of any third-party right by your Content; or (iv) any statutory damages, licensing fees or royalties payable to any rights-holder or collecting society as a result of your Content being made available on Frasogn. This indemnity survives termination.
6.Notice-and-takedown / DMCA
Frasogn complies with the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512), the EU Directive on Copyright in the Digital Single Market (2019/790), and applicable Icelandic copyright law (Höfundalög nr. 73/1972). Rights-holders may send notices of claimed infringement to copyright@frasogn.com. Upon receipt of a valid notice we may remove or disable access to the Content without prior notice to you, withhold associated earnings, and take the further enforcement steps set out in clause 7.
7.Enforcement, account termination & repeat infringers
If we determine, in our reasonable discretion, that Content is or may be infringing, misattributed, fraudulent, or otherwise in breach of these Terms, we may, at any time and without prior notice: (a) remove or hide the Content; (b) suspend or permanently terminate your creator account; (c) freeze, reverse and/or forfeit any accrued or pending earnings and payouts attributable to the Content, and use those amounts to satisfy claims, refunds, chargebacks, licensing fees, statutory damages or costs; (d) ban you from re-registering on Frasogn; (e) preserve and share your account information, IP address and Content with rights-holders, law-enforcement and courts as required by law or a valid legal request; and (f) pursue any and all remedies available at law or in equity, including injunctive relief. We operate a repeat-infringer policy and will terminate accounts of Creators who upload infringing Content on more than one occasion.
8.No obligation to monitor; provisional acceptance
Frasogn has no obligation to pre-screen, monitor or verify Content before or after upload. The technical acceptance of an upload does not constitute a determination by Frasogn that the Content is non-infringing, and does not waive any of Frasogn's rights or your obligations under these Terms.
9.Governing law & jurisdiction
These Terms are governed by the laws of Iceland, excluding its conflict-of-law rules. The exclusive venue for any dispute is the District Court of Reykjavík (Héraðsdómur Reykjavíkur), except that Frasogn may seek injunctive or equitable relief in any court of competent jurisdiction. Consumer-protection rights that cannot be waived under the law of your country of residence remain unaffected.
10.Acceptance
By ticking the acceptance box in the track upload dialog and clicking "Save & publish" or "Save as draft", you acknowledge that you have read, understood and agree to be legally bound by these Creator Content & Copyright Terms for the specific Content being uploaded and for every future upload you make to Frasogn until these Terms are superseded.
